Congressional Candidate Byron Donalds – “The President’s healthcare plan is unconstitutional”

 

NAPLES, FL –  SW Florida, congressional candidate Byron Donalds believes firmly that Obama Care in unconstitutional.  In a written statement to supporters Byron said “it is my hope that the Supreme Court of the United States will throw out the entire law.   This should happen because there was no severability clause put into the law by Congress.”

A severability clause, for those who are unfamiliar, means that if one portion of the document (usually a contract or in this case a law), is deemed unconstitutional or unenforceable, that the unenforceable provision or section is severed from the document as a whole.  In other words, the good stays in while that bad comes out.   Obama Care does not contain a severability clause.   Many pundits agree that because there is no severability clause, if a portion of the law is deemed unconstitional that the entire law should be thrown out.

In his statement, Byron says “the President’s supporters were so eager to push through this monstrous and disastrous bill for America, that they failed to protect their agenda from the inevitable question of the constitutionality of the individual mandate.  Then again, most them didn’t even read the bill before it was passed! – If the Supreme Court does not strike down Obamacare, it is the duty of this Congress and the next Congress to do everything possible to repeal that law.”

Byron Donald’s does acknowledge that healthcare reform is needed, but he does not believe wealth redistribution is the answer to the problem.   “The reason that the cost of medical care in America continues to increase, is that we are spending one person’s money on someone else.  The only way to control the cost of any good or service, is for people to buy it with their own money. This is where the President’s healthcare plan fails, and in fact, where the current healthcare system fails.”

Mr. Donald’s goes on to suggest that “American’s should buy their own health insurance directly, not through their employer – and any tax incentives currently given to the employer in this regard should be transferred to the individual (this would not be an issue if the Fair Tax were instituted). Our citizens should be able to purchase healthcare insurance across state lines, and finally, we must clean up the fraud and waste in Medicare to stop forcing our doctors to take losses… My plan will inject free market principles and personal responsibility…”
